2. Eligibility and Account Responsibility

A. Eligibility

• You must be 18 years or older and legally capable of entering contracts
• If using as a worker: You must be on a valid working holiday visa or eligible to work in Australia
• If using as a farm/employer: You must be legally operating an agricultural business in Australia
• You represent that all information provided is accurate, lawful, and truthful

B. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized access or use. We are not liable for unauthorized account use.

C. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, for violations of these Terms or other conduct we deem inappropriate. Termination may result in loss of access to all data and features.

3. Use License and Restrictions

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for lawful purposes only. You agree NOT to:

• Modify, copy, or create derivative works of the Service or its content
• Reverse engineer, decompile, or disassemble any software or code
• Rent, lease, loan, or transfer the Service to others
• Remove, alter, or obscure any proprietary notices (copyright, trademarks, etc.)
• Use the Service for any illegal or unauthorized purpose
• Engage in automated access or scraping of the Service (bots, crawlers)
• Interfere with or disrupt the Service or servers
• Circumvent any security or authentication measures
• Transmit viruses, malware, or any harmful code

4. User-Generated Content

Any content you submit (profile information, photos, reviews, messages) ("Your Content") remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute Your Content in connection with the Service.

Your Representations: You warrant that Your Content:

• Is legal, accurate, and does not violate any laws
• Does not infringe on third-party rights
• Is not defamatory, threatening, harassing, or abusive
• Does not contain malware or illegal content

We may remove any content that violates these Terms at our sole discretion.

5. Visa Eligibility & Immigration Disclaimers

**CRITICAL LEGAL NOTICE**

• NOT Legal Advice: The 88 Days Calculator and all information provided are for informational and planning purposes only. They do NOT constitute legal immigration advice.
• Your Responsibility: You are solely responsible for verifying your visa eligibility with the official Department of Home Affairs (immi.homeaffairs.gov.au) and consulting a qualified immigration lawyer if needed.
• No Guarantee: We cannot guarantee that any work will qualify toward your 88-day requirement or that you will obtain a visa extension. Individual circumstances vary and rules may change.
• Employment Verification: You must ensure all employment is properly documented with payslips, tax records, and employer verification. Cash-only employment may not be accepted by immigration authorities.
• Your Risk: You assume all risk related to your visa status and immigration obligations. We are not responsible for visa denials, cancellations, or immigration issues.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

A. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES INCLUDING:

• Fitness for a particular purpose
• Merchantability
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation

B. No Liability

WE SHALL NOT BE LIABLE FOR:

• Lost profits, revenue, or data
• Loss of goodwill or business opportunity
• Indirect, incidental, or consequential damages
• Personal injury or property damage
• Disputes between users (workers and farms)
• Employment-related issues or wage disputes
• Immigration decisions or visa denials
• Third-party actions or content
• Service unavailability or interruption

C. Damage Cap

IN NO EVENT SHALL XXX BE LIABLE FOR DAMAGES EXCEEDING THE TOTAL AMOUNT YOU PAID US (IF ANY) IN THE PRECEDING 12 MONTHS.

D. Exceptions

Nothing herein limits liability for fraud, gross negligence, death, personal injury, or as otherwise prohibited by law.

7. Indemnification

You agree to defend, indemnify, and hold harmless XXX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your content or user-generated content
• Claims by third parties related to your conduct
• Your violation of any applicable laws or regulations

8. No Employment Relationship

XXX is a platform connecting workers with farms. We are NOT an employment agency, employer, co-employer, or party to any employment relationship. We do not:

• Set wages or employment terms (negotiated directly between parties)
• Employ any users or workers
• Manage employment relationships
• Provide workplace benefits or insurance
• Withhold taxes or superannuation (users must handle independently)
• Provide workers compensation coverage

Your Responsibility: You are responsible for all employment obligations, tax filings, visa compliance, and employment law adherence.

9. Payment and Subscription Terms

A. Payment Processing

• Payments are processed by Stripe Payment Services
• You authorize us to charge your payment method for subscriptions or purchases
• All prices are in AUD unless otherwise specified
• Your credit card will NOT be stored by us (Stripe handles securely)

B. Subscription Billing

Subscriptions will renew automatically on the billing date. You may cancel anytime. Cancellation becomes effective at the end of the current billing cycle.

C. Refund Policy

We are not responsable for failed or blocked transactions. We offer a 7-day money-back guarantee on all new subscriptions. If you are not satisfied within 7 days of your initial purchase, contact us for a full refund - no questions asked. After 7 days, no refunds are issued for partial billing periods. Refund requests must be submitted via our contact page. Refunds are issued to the original payment method within 5–10 business days.

10. Third-Party Content and Links

Our Service may contain links to external websites and resources. We are not responsible for:

• Availability or accuracy of external content
• Third-party privacy practices
• Third-party terms of service
• Viruses or malware from external sites

Your use of external sites is at your own risk and governed by their terms and privacy policies.

11. Intellectual Property

All content provided by XXX (text, graphics, logos, images, software) is our intellectual property or licensed from third parties. You acquire no ownership rights in the Service.

A. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.

B. Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the courts located in New South Wales, Australia.

C. Dispute Process

13. Modifications to Terms and Service
